Both the buyer and the seller need the services of an experienced real estate lawyer. Buying real estate is the biggest purchase most people will make in their life time. Lawyers for both parties protect their clients from unforeseen problems that might arise during the buying and selling process.
Sellers need an attorney to draft the Purchase & Sale. The attorney negotiates to protect the seller if the buyer defaults. They also prepare the new deed when the home transfers from the old owner to the new one.

Step One: The Offer to Purchase
The offer to purchase document is drawn up by the buyer and their real estate agent. The document includes the price, terms and dates being offered to the seller. The buyer’s agent sends the offer to purchase to the listing agent or the seller’s agent, who in turn presents the offer to the seller.
Step Two: The Purchase and Sale Agreement
The purchase and sale agreement is typically prepared by the seller’s attorney then reviewed and negotiated by the buyer’s counsel.
